General
In these conditions references to "the Company" are to Incantation and references to "the Purchaser" are to any person, firm or company with whom the Company enters into any contract whether directly or indirectly.
All quotations or tenders given and all orders received and accepted are executed on the basis that the Purchaser is bound by these conditions of sale. Where there is any inconsistency between these conditions of sale and any conditions or other terms which the Purchaser seeks to impose these conditions of sale shall prevail. These conditions supersede any other terms appearing elsewhere and exclude and override any other terms or representations stipulated or incorporated or referred to by the Company whether in the order or in any negotiations or course of dealings established between the Company and the Purchaser. No amendment or variation of these conditions will apply unless confirmed in writing by a director of the Company.
Prices
Unless otherwise agreed in writing, all orders are accepted subject to prices and any related discount applying at the date of delivery and any price list of the Company whether published or not shall not affect the right of the Company to charge for goods in accordance with this clause. All prices are inclusive of VAT at the current rates and are correct at the time of entering the information onto this website. The total cost of the order is the price of the products ordered plus postage and packing charges where applicable. Prices are subject to change at the discretion of Incantation.
Payment
Until such time as the Company has confirmed credit account facilities in writing, payment is due in full in sterling at the time of order. Where the contract provides for separate instalments, deliveries or parts, payment for each instalment, delivery or part shall be made as it the same constituted as separate contract. The Company shall have the right to invoice the Purchaser for a partial delivery of the goods.
Methods of Payment:
We accept Mastercard, Visa, DUET, Delta, Switch, Maestro and Solo. We do not charge for any item until it is ready to ship. You may send your credit card information via phone, fax, snail mail or over the Internet. If you are shopping from overseas, place your order and your credit card company will convert the transaction to your own currency.
Credit Card Security:
This website uses a third party secure hosting company to process all transactions on secure servers, offering customers the highest level of security when entering credit card details over the internet. We use a 128 bit SSL (Secure Sockets Layer), the strongest commercially available level of encryption. All private data will be encrypted at all times whilst in transit over the Internet. They are only decrypted after they reach our computer. When checking out your shopping bag you should see a solid padlock in your browser status bar which indicates that the encryption is taking place.
Property
Title to the goods shall remain the property of the Company until the Company has received all payments which are owing to it by the Purchaser under any account whatsoever. While the goods are the property of the Company the Purchaser shall hold them as bailee on behalf of the Company and shall keep the goods safe, insured, separate and identifiable from all other goods in its possession.
Delivery
Carriage charges:
Cost of carriage is to be paid for by the Purchaser at the time of order. The Company reserves the right to choose the mode of transport and to charge for deliveries at a rate relevant to the time and cost in undertaking such a delivery.
Where to?
The prices below are for UK delivery only, which includes all postal areas in England, Scotland, Wales, Northern Ireland and the Channel Islands.
We can deliver to the Republic of Ireland, however there may be a small additional charge (please telephone or e-mail us for a quote) and please be aware that deliveries to the Channel Islands and the Isle of Man may be delayed by customs.
For overseas orders our delivery rates are very competitive, we will quote charges on receipt of your order. Please ignore any delivery figure quoted when placing your order.
Next day delivery is available on orders placed before noon - please call 07941 315260 to place your order and for delivery charges.

Delivery Time:
Stock permitting, orders are usually processed and goods dispatched within seven working days, however please allow up to 28 days for delivery within the UK. Delivery may require a signature, so please be certain to have the goods delivered to an address where someone can accept your parcel. Maybe they could be delivered to you at work if you’re not at home during the day?
If there are any problems with your delivery, we will notify you immediately.

Postage and packing is £1.99 in the UK (however many are ordered)!
Barro Negro
Barro Negro charge a fixed fee of £4.99 per shipment.
This is due to the high cost of packaging and posting of fragile items.

Loss or damage in transit
Any times quoted for dispatch, repair or replacement are to be treated as estimates only and time shall not be of the essence. The Company shall not be liable for any loss whatsoever arising as a result of any delay. Delivery shall occur on dispatch or collection of the goods from the Company's premises by carrier whether or not the carrier is the Company's agent or servant. Unless otherwise agreed in writing the Company shall deliver the goods to the address specified in the Purchaser's order. Risk in the goods shall pass to the Purchaser on delivery or collection. Save as expressly provided in these conditions, all terms, conditions, representations and warranties (whether expressly or implied) relating to the sale of goods are excluded and the goods are not sold by description or sample.
Warranty and exclusion
The Company will use its reasonable endeavours to assign the benefit of any warranty it receives from its supplier to the Purchaser but shall not be liable for any claim or claims for any damages whether direct, indirect special or consequential or economic damage of loss (including loss of profit or goodwill) arising from any breach by its contract or any defect in the goods. Nothing in these conditions shall exclude liability of the Company for death or personal injury resulting from its negligence insofar as the same prohibited by United Kingdom statute.
Specification
Whilst every effort has been made to display the colours of our products as accurately as possible on our website, the actual colours you see will depend on your own monitor.
We cannot guarantee that the colour displayed on your monitor will be a pure reflection of the colour of the product on delivery.
We take all reasonable care to ensure that all details, descriptions and prices of products appearing on our website are correct at the time the information is entered onto the system.
All dimensions are in cm and measured at the widest point. Some variations may occur as all our products are handmade.
Cancellation, returns and back orders
Where products supplied by the Company are manufactured to the particular specification of the Purchaser, the Purchaser does not have the right to cancel. Mistakes made by the Purchaser when ordering cannot be used as reasons to cancel the order. If an error is made by the Company, the Purchaser should contact the Company within three working days by email or telephone and make arrangements to return the goods, at which point the Company will offer the choice of a refund or replacement. If such an error has been made the Company will also seek to compensate the Purchaser for any costs incurred in returning the goods to the Company. Where goods are not returned, the Company reserves the right to charge for the direct recovery of goods which may be equal or greater than the initial order value.
Returns Policy:
If you are not completely happy with the products you have purchased, please inform Incantation within 7 days of receiving your order. We will issue you with a Returns Authorisation Number. No returns can be accepted without a RAN. We are happy to make a refund or exchange, providing the products are in perfect condition, unused and in their original packaging. The delivery charge on the original order is non-refundable.
In the unlikely event that your goods are faulty or are damaged in transit, we will replace or refund in full including postage upon return of the damaged item. Your statutory rights are not affected. Where you exercise the right to cancel an order, Incantation will make a full refund within 30 days of cancellation
Back Orders:
If your item is not in stock, we will back order for you. You will always be emailed with the option to cancel your order if you would rather not wait.
Legal constructions
These conditions and any contract following thereon shall be governed by and construed in accordance with English Law and the Purchaser submits to the jurisdiction of the High Court of England but the Company may enforce the contract in any court of competent jurisdiction. |
